This year theme of World Intellectual Property Day April 26, is “Creativity – The Next Generation”

Nowadays mankind creates and develops in a very dynamic and exciting pace. Life sciences together with the new technologies generate a great potential for development. They are transforming the way we live, communicate, heal, entertain, work or study.

“What will the next generation bring?” – It’s difficult to predict the future. The rapid everyday change of our universe based on innovations, new high technologies and creativity takes place in every sphere of our life.

And the role of Intellectual property and people is to support that rapid move by creating “a unique incentive for investment in research and development, in innovation, and in cultural creation and production”.

This year’s message of Mr. Francis Gurry is turned to the young – the future of our planet: “Young people have the capacity to dream in a way that far surpasses the capacity of older people. They are the future. So my message to the next generation on World IP Day is keep creating, keep innovating. And keep thinking about how IP should fulfill its role in the future social management of creativity and innovation.”

A change of significant importance for all holders of trademark rights in Montenegro should be highlighted. It concerns trademarks that were registered before 28 May 2008, (this being the day when the Intellectual Property Office of Montenegro (hereinafter: the “Montenegrin Office”) commenced operations, upon the dissolution of the State Union of Serbia and Montenegro). The Law stipulates that the trademarks registered in the Intellectual Property Office of Serbia and Montenegro (hereinafter: the “SM Office”) or in the Intellectual Property Office of Serbia (hereinafter: the “Serbian Office”) before 28 May 2008 are valid in Montenegro, provided that the trademark holder submits an application for the recognition of the trademarks to the Trademarks Register of the Montenegrin Office.

Please note that for trademarks where the following applications have already been submitted to the Montenegrin Office are exempt from the obligation of filing the request for recognition:

• an application for the renewal;
• a request for the transfer of rights; and
• a request to change the name and address of the holder.

The deadline for the submission of an application for recognition at the Trademark Register of the Montenegrin Office is 16 December 2011.

An interpretation of the provisions of Article 65 of the Law leads to the conclusion that if the applications for registration are not submitted by the specified deadline, the trademarks will become invalid within the territory of Montenegro.

Во своето обраќање на присутните, тој искажа некои свои битни размисли околу тоа дека интернетот треба да е алатка за стварање мир, и треба да е бесплатен, како и тоа дека никогаш немал на ум да го патентира својот изум WWW, кој денес е значаен за човештвото.

Novelties introduced by these laws are mostly related to the harmonization of regulations with the current European practice.

Leaving the system of substantial examination and accepting the system of publication and opposition is the most significant change that was introduced in the new text of the trademark law .

It is expected new regulation books and new tariffs that will complete the implementation of the new laws.

Преостанува донесувањето на нови правилници и тарифи кои ќе го заокружат стапувањето во сила на новата регулатива.

The deadline for re -regiistration the rights of national trademarks that were registered in Serbia valid for the territory of Montenegro, expires on December 16th 20011.

Regarding this important deadline, Berin informs all holders of such registrations to take appropriate actions, timely.

Рокот за повторна регистрaција на правата на националните трговски марки, кои биле регистрирани на теритoријата на Србија и важеле за територијата на Црна Гора, истекува на 16 декември 20011година.

По тој повод ги информираме сите носители на вакви регистрации да се обратат на Берин, за да се превземет навремено соодветни постапки.

Ова значи големо олеснување за носителите кои поседуваат голем број на трговски марки за кои предходно таксите се плаќаа а секое право за кое се бараше спроведување на овој превентивен начин на спречување на повреди на права од индустриска сопственост.

Минатата, 2010, година Европскиот завод прими 235 000 нови пријави што значи зголемување за 11% во однос на предходната година и постигнат е рекорден број на нови пријави во 34-годишната историја на заводот. Трендот на пораст беше стабилен се до 2008 година кога настана промена во трендот кој се должење на глобалната рецесија.

Last year, the EPO received 235 000 European patent filings, and increase of 11 % on the previous year and the highest number of patent filings recorded in the Office’s 34-year history. Until 2007, growth had been steady, but it slowed in 2008 and the number of filings even dropped in 2009 as a result of the recession.

“The figures are clear: growth is back,” EPO President Benoît Battistelli said. “In 2010 there was an increase in demand for patent protection from every region of the world. After a two-year slump the EU and US are nearly back to their levels of patenting of before the crisis. This combined with a massive rise in patent applications from Asia – led by China – has made 2010 a record year at the EPO.”

At the meeting with Mr.Yoshiyuki Iwai besides Filipov, Mr. Bojan Petrovski, economic promotor of Macedonia in Japan and Mrs. Liljana Filipova, European Pattent Attorney and ambassadors wife were present.

Japan patent office is established in 1885 and is one of the worlds oldest IP institution and leads setting of trends in the promotion, administration and protection of patent rights.

Јапонскиот патентен завод, е формиран во 1885 година една од најстарите институции од оваа област во светот и многу значаен за сите водечки трендови поврзани со промоцијата, администрацијата и заштитата на на патентнните права, негов прв комесар пред повеке од 115 години бил г-динот Такахаши Кореклио(Takahashi Korekiyo) .

On this occasion, the coordinative body have organised public destruction of products that violate the intellectual property rights that were seized during the numerous actions by them.

State Office of Industrial Property have promoted several published titles with texts of international regulative and classifications, which would surely enrich available literature in this area into Macedonian language.

По тој повод координативното тело за ИС изврши јавно уништување на производи кои ги повредуваат правата од интелектуална сопственост, кои биле запленети во текот на многубројните акции кои ги координирало ова тело.
